Welcome to Klaylist. These Terms of Service (“Terms”) govern your access to and use of the Klaylist website, mobile application, and related services (collectively, the “Platform”).

The Platform is operated by KLAYLIST, having its registered office at:

For the purposes of these Terms, KLAYLIST may be referred to as “Klaylist,” “we,” “us,” or “our,” and the person accessing or using the Platform may be referred to as “you” or “your.”

By accessing the Platform, creating an account, placing an order, or otherwise using any service provided through the Platform, you acknowledge that you have read, understood, and agreed to these Terms and the policies referred to in them.

If you do not agree with these Terms, please do not access or use the Platform.

1. ABOUT KLAYLIST

Klaylist operates an online platform through which products and related services may be offered to customers.

The products, prices, availability, descriptions, photographs, specifications, and other information displayed on the Platform may change from time to time.

Klaylist reserves the right to introduce, modify, suspend, or discontinue any product, feature, service, or portion of the Platform at its discretion.

2. ELIGIBILITY TO USE THE PLATFORM

By using Klaylist, you confirm that:

  • you are legally capable of entering into a binding agreement under applicable law;
  • the information you provide to us is accurate and complete;
  • you will use the Platform only for lawful purposes; and
  • you will comply with these Terms and all applicable laws and regulations.

If you are below the age required to independently enter into a binding contract under applicable law, you may use the Platform only with the involvement and consent of your parent or legal guardian.

3. ACCOUNTS AND CUSTOMER INFORMATION

Certain features of the Platform may require you to provide information such as your name, telephone number, email address, billing details, shipping address, or other information necessary to process your order.

You are responsible for ensuring that the information supplied to Klaylist is accurate and up to date.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account.

Please notify us promptly if you believe that your account or account credentials have been accessed or used without authorization.

4. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product names, descriptions, images, specifications, colours, sizes, and other information displayed on the Platform are accurate.

However, the appearance of a product may vary depending on your device, screen settings, lighting, photography, or other technical factors.

Minor variations in colour, texture, finish, dimensions, packaging, or appearance do not necessarily constitute a defect.

Product availability is subject to change without notice. A product appearing on the Platform does not guarantee that it will remain available when you place an order.

5. PRICING

The prices displayed on the Platform are the prices applicable at the time of purchase, subject to applicable taxes, shipping charges, discounts, or other charges that may be displayed during checkout.

Klaylist may change prices at any time.

If an obvious pricing or listing error occurs, we reserve the right to correct the error and, where appropriate, cancel or amend an affected order. If an order is cancelled after payment has been received, the applicable amount paid for that cancelled order will be refunded in accordance with our refund procedures.

6. PLACING AN ORDER

When you place an order through the Platform, you are making a request to purchase the selected product or products.

An order acknowledgement or confirmation does not necessarily constitute final acceptance of the order. Klaylist may decline, cancel, or limit an order where permitted by applicable law, including where:

  • the product is unavailable;
  • there is an error in product information or pricing;
  • the order appears fraudulent or unauthorized;
  • there are delivery limitations;
  • the order appears to have been placed for unauthorized resale; or
  • circumstances beyond our reasonable control prevent fulfilment.

Where an order is cancelled after payment has been received, the eligible amount will be returned using the applicable payment or refund method.

7. PAYMENT

Payments may be processed through third-party payment providers made available on the Platform.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Klaylist does not intentionally retain complete payment-card credentials where such information is processed by an authorized payment service provider.

Payment processing may be subject to the terms, privacy policies, and security practices of the relevant payment provider.

8. SHIPPING AND DELIVERY

Orders are delivered to the shipping address provided during checkout.

Delivery estimates displayed on the Platform are indicative and may be affected by factors including product availability, logistics operations, weather, public holidays, transportation disruptions, incorrect address information, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and contact information.

If an order cannot be delivered because of incorrect or incomplete information supplied by you, additional delivery arrangements or charges may apply where permitted by law.

9. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges, cancellations, and refunds are governed by Klaylist's applicable Refund and Returns Policy, as published on the Platform.

Eligibility may depend on factors including the nature of the product, condition of the product, time elapsed since delivery, reason for return, and any exclusions stated in the applicable policy.

Before returning a product, customers should review the applicable Returns Policy and follow the stated procedure.

Nothing in these Terms is intended to restrict any rights or remedies that cannot lawfully be excluded under applicable law.

10. PROMOTIONS AND DISCOUNTS

From time to time, Klaylist may offer promotional codes, discounts, campaigns, or other special offers.

Unless expressly stated otherwise:

  • promotional offers may be subject to additional conditions;
  • only one promotional code may be applicable to an order;
  • promotional offers may have limited validity;
  • offers may not be combined; and
  • Klaylist may withdraw or modify a promotional offer where permitted by law.

Any specific terms displayed with a promotion will apply in addition to these Terms.

11. THIRD-PARTY SERVICES

The Platform may rely on third-party services for functions such as payment processing, shipping, analytics, hosting, communications, authentication, or other technical services.

Certain third-party services may have their own terms and privacy policies. Your use of such services may therefore be subject to those third-party terms.

Klaylist is not responsible for the independent operation, availability, or policies of third-party services except to the extent required by applicable law.

The Platform may contain links to websites or services operated by third parties.

These links are provided for convenience and do not necessarily constitute an endorsement by Klaylist.

Klaylist does not control third-party websites and is not responsible for their content, availability, security, policies, or practices. You should review the terms and privacy policies applicable to any third-party website before using it.

13. USER CONTENT AND FEEDBACK

If you submit reviews, comments, suggestions, photographs, feedback, or other material to Klaylist, you are responsible for ensuring that the material is lawful and does not infringe the rights of another person.

You must not submit content that:

  • is unlawful, fraudulent, threatening, abusive, defamatory, or obscene;
  • infringes copyright, trademark, privacy, or other rights;
  • contains malicious software or harmful code;
  • impersonates another person or organization; or
  • contains misleading information intended to deceive others.

By submitting feedback or other content to Klaylist, you grant us a non-exclusive, royalty-free, worldwide right to use, reproduce, adapt, publish, display, and distribute that content for legitimate business, promotional, operational, or service-improvement purposes, subject to applicable law.

We may remove or decline to publish content that we reasonably believe violates these Terms or applicable law.

14. INTELLECTUAL PROPERTY

The Platform and its contents, including its design, branding, logos, text, graphics, photographs, product descriptions, software, layout, and other materials, are owned by or licensed to Klaylist unless otherwise indicated.

You may access and use the Platform for personal and lawful purposes.

You must not, without prior written permission from Klaylist:

  • reproduce or commercially exploit Platform content;
  • copy or redistribute substantial portions of the Platform;
  • modify or create derivative works from our protected materials;
  • use our branding or trademarks in a misleading manner;
  • systematically scrape or collect Platform content; or
  • interfere with the operation or security of the Platform.

All rights not expressly granted under these Terms are reserved.

15. ACCEPTABLE USE

You agree not to use the Platform to:

  • violate any applicable law or regulation;
  • commit fraud or facilitate fraudulent activity;
  • interfere with the security or operation of the Platform;
  • introduce viruses, malware, or other harmful code;
  • attempt unauthorized access to accounts, systems, or data;
  • collect another person's personal information without authorization;
  • impersonate another person or entity;
  • infringe intellectual property or other legal rights;
  • use automated systems to access or scrape the Platform in a manner that has not been authorized by Klaylist; or
  • otherwise misuse the Platform.

Klaylist may restrict or suspend access where we reasonably believe that a user has violated these Terms or applicable law.

16. AVAILABILITY AND SERVICE INTERRUPTIONS

We aim to keep the Platform available and functional, but we do not guarantee uninterrupted or error-free access.

The Platform may occasionally be unavailable because of maintenance, upgrades, technical problems, security incidents, network issues, or circumstances outside our reasonable control.

Klaylist may modify or discontinue features of the Platform from time to time.

17. ACCURACY OF INFORMATION

We endeavour to provide useful and current information on the Platform. However, information may occasionally contain typographical errors, inaccuracies, omissions, or outdated information.

Where permitted by law, Klaylist reserves the right to correct such information and update product details, prices, availability, promotions, or other Platform content.

We are not required to update every piece of information immediately unless required by applicable law.

18. DISCLAIMERS

To the maximum extent permitted by applicable law, the Platform and its features are provided on an “as available” basis.

Klaylist does not guarantee that:

  • the Platform will always be available;
  • the Platform will be completely free from errors;
  • information displayed will always be complete or current; or
  • every product or service will always be available.

Nothing in these Terms excludes or limits any warranty, guarantee, right, or remedy that cannot legally be excluded or limited under applicable law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Klaylist will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from your use of the Platform where such liability may lawfully be excluded.

This may include loss of profits, business interruption, loss of data, or other indirect losses.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot legally be excluded or limited.

20. INDEMNITY

To the extent permitted by applicable law, you agree to indemnify and hold harmless Klaylist, its personnel, contractors, service providers, and affiliates from claims, losses, liabilities, costs, and reasonable expenses arising from:

  • your material breach of these Terms;
  • your unlawful use of the Platform;
  • your violation of another person's rights; or
  • content submitted by you that violates applicable law or these Terms.

21. SUSPENSION AND TERMINATION

Klaylist may suspend or restrict access to the Platform where reasonably necessary, including where there is a suspected violation of these Terms, fraudulent activity, security risk, or unlawful use.

You may stop using the Platform at any time.

Any provisions which by their nature should continue after termination, including provisions concerning intellectual property, liability, indemnity, and dispute-related matters, will continue to apply where appropriate.

22. PRIVACY

The collection and use of personal information through the Platform is governed by our Privacy Policy.

By using the Platform, you acknowledge that your information may be collected and processed in accordance with that policy and applicable law.

23. CHANGES TO THESE TERMS

Klaylist may update these Terms from time to time to reflect changes to our Platform, business practices, legal requirements, or services.

The updated version will be published on the Platform with a revised “Last Updated” date.

Your continued use of the Platform after updated Terms become effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.

24. GOVERNING LAW

These Terms are governed by and interpreted in accordance with the laws of India.

Subject to any mandatory rights available to consumers under applicable law, disputes arising in connection with these Terms or your use of the Platform shall be subject to the jurisdiction of the appropriate courts having jurisdiction over Klaylist's registered office.

Nothing in this section prevents a consumer from exercising a right to approach a forum, authority, or court that has jurisdiction under applicable consumer-protection law.

25. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or severed to the extent necessary, while the remaining provisions will continue to apply.

26. NO WAIVER

If Klaylist does not immediately enforce a provision of these Terms, that does not mean that Klaylist has waived its right to enforce that provision later.

27. ENTIRE AGREEMENT

These Terms, together with the policies expressly incorporated into them and any additional terms presented to you when using particular features of the Platform, constitute the agreement governing your use of Klaylist.

If there is a conflict between these Terms and a specific policy or transaction-specific term, the specific provision will apply to the extent of the conflict.
